e-Pay Disclosure
The purpose of this Agreement and Disclosure statement is to inform you of certain rights which you have under the Electronic Funds Transfer ACT (EFTA).

This Agreement between you and Jersey Shore Federal Credit Union contains the terms, conditions and disclosures for Jersey Shore Federal Credit Union e-Pay Services for which you have applied. In this agreement the terms "Us", "Our" or "We" mean the credit union and the words "I", "me", "you" and "your" meaning each person agreeing to the membership application as applicant, joint owner, or authorized users and/or using e-Pay and the word "account" meaning any one or more checking accounts you have with the credit union hereby agree to be legally bound by the following terms and conditions.

1. Account Access

I understand that to use e-Pay I must have a personal computer or mobile device sufficient to use this software, a United States address with the credit union, Internet access through an Internet service provider (ISP), Internet browser software or mobile app.

I also understand that the credit union does not make any warranties on any equipment, hardware, software or ISP, or any part of them, express or implied, including, without limitation and warranties of merchantability or fitness for a particular purpose. The credit union is not responsible for any loss, injury or damages, whether direct, indirect or consequential, caused by the ISP, modem connection, any related software or the credit union's e-Pay and/or e-Branch services or the use of any of them arising in any way out of the installation, use or maintenance of my personal computer or mobile device hardware, software or other equipment.

I further understand that e-Pay service is available through the credit union's website or mobile app seven (7) days a week, twenty-four (24) hours a day except during system updates, network maintenance and technical difficulties and that the Credit Union cannot guarantee account access. In addition, access to e-Pay is made available pursuant to a license agreement by and between Jersey Shore Federal Credit Union and a third party vendor. Any interruption of service or access by the vendor may also prevent the use of service. To utilize the services, I will need to satisfy the system's security procedures.

2. Account Information

The account balance and transaction history information may be limited to recent account information involving your accounts. Also, the availability of funds for transfer or withdrawal may be limited due to the processing time for unposted transactions such as ATM, MasterCard Debit Card, and our Funds Availability Schedule.

3. E-Mail

E-mail messages that you send may not be received immediately and the credit union may not be able to take immediate action. If you need to contact the credit union regarding an unauthorized transaction, please call us at the number set forth in the Contacting the Credit Union Section 14.

4. Password/PIN

You acknowledge that the password you use is your signature, which identifies you as the user at e-Pay and /or e-Branch and authenticates and validates the directions given just as your actual signature and other proof identify you and authenticate and validate your directions to a human teller. You also acknowledge that your password is an identification code that's personal and confidential and that the use of the password at e-Pay and/or e-Branch is a security method by which we are helping you to maintain the security of your account(s). Therefore, YOU AGREE TO TAKE ALL REASONABLE PRECAUTIONS THAT NO ONE ELSE LEARNS YOUR PASSWORD.

5. Bill Payment Processing

a) Single Payment - If you designate a bill payment as a one-time transaction, you may request that the transaction be made on a future date that you designate. The processing date will be the effective date that you entered, or the next business day should the effective date fall on a weekend or holiday or is after the cutoff time for the credit union bill payment processing day. Sufficient funds must be available on the processing day.

b) Recurring Payments - When a recurring payment is processed, it is automatically rescheduled by the system. Based upon your selected frequency settings for the payment, a process date is calculated for the next occurrence of the payment. If the calculated process date is a non-business date (generally weekends and observed holidays), it is adjusted based upon the following rules:

i. If the recurring payment‘s "Pay Before” option is selected, the process date for the new occurrence of the payment is adjusted to the first business date prior to the calculated process date.

ii. If the recurring payment’s "Pay After” option is selected, the process date for the new occurrence of the payment is adjusted to the first business date after the calculated process date.

c) The system will calculate the Estimated Arrival Date of your payment, this is only an estimate, please allow ample time for your payments to reach your "Payees”.

d) Please note if your frequency settings for the recurring payment specify the 29th, 30th, or 31st as a particular day of the month for processing and that day does not exist in the month of the calculated process date, then the last calendar day of that month is used as the calculated process date.

e) Bill payment may be canceled or changed until 12:30 PM (Eastern Time) on the scheduled payment date.

6. Payment of Bills

The credit union will only be responsible for exercising ordinary care in making payments upon your authorizations or sending a payment to the designated payee. The credit union is not liable in any way for damages you may incur if you do not have sufficient funds in your account to make the payment on the payment date, if the estimate of time to allow for delivery to the payee is inaccurate, or due to delays in mail delivery, changes of merchant address or account number, the failure of any merchant to account correctly for or credit the payment in a timely manner, or for any other circumstances beyond the control of the credit union. The credit union reserves the right, without liability, to reject or reverse a bill payment if you fail to comply with the requirements or any other term of this agreement.

7. Payees and Payments

a) If you want to add a new payee, select the "Payee” tab located in your Bill Pay application or speak to a service representative.

b) You may add a new fixed payment to a "Payee” by accessing the service and entering the appropriate information. Most other additions, deletions, or changes can be made in writing or by using the service.

c) The credit union reserves the right to refuse the designation of a "Payee” for any reason.

d) You may pay any "Payee” within the United States (including U.S. territories and APO’s).

8. Limitations

a) Bill payments cannot exceed $25,000 each.

b) Person to person payments cannot exceed $1,000 each.

c) Transfer (credit union to another institution) payments cannot exceed $25,000 each.

9. Stop Payment Procedure

You may cancel or modify a payment prior to 12:30 PM (Eastern Time) on the payment date. If you need to stop payment after that time you will need to contact the credit union during normal business hours of Monday through Friday (excluding observed holidays), 9:00 AM to 5:00 PM (Eastern Time), at 609-646-3339. Please be aware that stop payments after the cutoff time are not guaranteed and fees may apply.

10. Authorization to Charge Account

You authorize the credit union to charge your checking account for any transactions posted through the use of e-Pay, including the amount of any bill payment that you make, and any charges for the service. You further understand that in adding or maintaining payees, even if no payments are scheduled, you are electing to use the full e-Pay service and therefore will be charged accordingly. You authorize us to process bill payments according to the instructions we receive from you through e-Pay. You authorize us to initiate any reversing entry, and to debit your account at the credit union, in order to correct any mistaken credit entry. You understand that if a bill payment request describes the payee inconsistently by name and account number, execution of the request will occur on the basis of the account number even if it identifies a person different from the named payee. Further the credit union and other financial institutions to which a bill payment request is forwarded may rely on any information supplied by you, even if those numbers are incorrect. Your obligation to pay the amount of the bill payment to the credit union is not excused in such circumstances.

11. Record of Transactions

In addition to online e-Branch and e-Pay history, you will receive a monthly statement showing the status of your account(s), transactions made during the past month, and any charges we may impose for such services or transactions.

12. Liability

a) The credit union is not responsible for a bill payment that is not made if you did not properly follow the instructions for making a bill payment.

b) The credit union is not liable for any failure to make a bill payment if you fail to promptly notify the Financial Institution after you learn that you have not received credit from a "Payee” for a bill payment.

c) The credit union is not responsible for your acts or omissions or those of any other person, including, without limitation, any transmission or communications facility, and no such party shall be deemed to be the financial institution's agent.

d) In any event, the credit union will not be liable for any special, consequential, incidental, or punitive losses, damages, or expenses in connection with this agreement or the service, even if the financial institution has knowledge of the possibility of them.

e) The credit union is not liable for any act, failure to act or delay in acting if it is caused, in whole or in part, by any cause beyond the credit union's reasonable control.

f) The credit union is not liable if your account funds are subject to legal process or other encumbrance restricting the transaction

13. Liability for Unauthorized Transactions

You are responsible for all transactions you authorize using Online Bill Payment under this agreement. YOU AGREE THAT IF YOU GIVE YOUR PASSWORD/PIN TO SOMEONE ELSE TO USE, YOU ARE AUTHORIZING THEM TO ACT ON YOUR BEHALF AND YOU WILL BE RESPONSIBLE FOR ANY USE OF THE PASSWORD/PIN BY THEM. However, you agree to contact us AT ONCE if you believe password has been stolen, believe an electronic fund transfer has been made without your permission, the security of your account(s) has been compromised or any unauthorized activity appears on your account(s). Telephoning is the best way of keeping your possible losses down. If you tell us within two (2) business days of learning of the loss, theft or compromise, you can lose no more than $50.00. If you do not tell us within two business days after you learn of the loss, theft or compromise, and we can prove we could have stopped someone from accessing your account without your permission if you had told us you could lose as much as $500.00. You also agree that if your monthly statement show transactions which you did not make or authorize, you agree to contact us AT ONCE. If you do not contact us within 60 days after the statement was mailed to you, you may not recover any monies lost after that time. If extenuating circumstances kept you from informing us of the loss or theft, we will reasonably extend time periods.

14. In Case of Errors or Questions about Your Transactions

In case of errors or questions about your e-Pay transactions appearing on your statement, telephone or write to us as soon as possible. We must hear from you no later than 60 days after we sent you the first statement on which the problem or error appeared. Please include:

a) Your name, account number;

b) A description of the suspected error or the transaction you are unsure of with an explanation of why you believe it is an error or why you need more information; and

c) The dollar amount of the suspected error

We will investigate your complaint and will correct any error promptly. If you report a suspect error or question a transaction by telephone or by email we may require you to send us your complaint or question in writing within ten (10) business days. Our business days are Monday through Friday excluding Saturday, Sunday and legal holidays.

After we receive your complaint or inquiry, we will tell you the results of our investigation within ten (10) business days but no later than 45 calendar days after receiving a notice of error. If a notice of error involves an electronic fund transfer that was not initiated in the United States of America, the applicable time period for action shall be twenty (20) business in place of 10 business days, and 90 calendar days in place of forty-five (45) days. If we decide that there is no error, we will send you a written explanation within three (3) days after we finish our investigation.

Contacting the Credit Union

I agree to contact the credit union immediately, if unauthorized activity occurs on my account by telephoning the credit union during normal business hours of Monday through Friday (excluding observed holidays), 9:00 AM to 5:00 PM (Eastern Time), at 609-646-3339 and by confirming such in writing at:

15. Privacy Statement

We will disclose account information to third parties:

a) Where it is necessary to complete transactions;

b) In accordance with service providers’, auditors’, collection agents’ or attorneys’ duties; or

c) If you give us written permission.

16. Change in Terms

You agree that from time to time the credit union may change the terms of this e-Pay Agreement including changes to add further services or to change the charge for these services. The credit union may do so by notifying you in writing of such changes and the use of e-Pay after the effective date of any such change shall constitute my acceptance of an agreement to such change. We will give you notice electronically or by mailing a copy of the change to you at your most recent address shown on our records.

17. Ownership

You agree that this account is not transferable and also agree the use of e-Pay is a privilege and the credit union has the right to suspend or terminate the use of e-Pay by oral and written notification.

18. Suspension of Privileges

We may at any time, and in our sole discretion, limit or terminate the e-Pay services we offer you. You may cancel your e-Pay service at any time. Any outstanding fees or charges will be collected at the end of the month in which service was cancelled.

19. Right of Offset

You agree that any and all shares in the credit union are pledged for any debts and loans owed to the credit union.

20. Enforcement

You agree to be liable to the credit union for any liability, loss or expense as provided in this Agreement that the credit union incurs as a result of any dispute involving your accounts or services. In the event either party brings a legal action to enforce the Agreement or collect any overdrawn funds on accounts accessed under this Agreement, the prevailing party shall be entitled, subject to applicable law, to payment by the other party of its reasonable attorney's fees and costs, including fees on any appeal, bankruptcy proceedings, and any post-judgment collection actions, if applicable.

21. Applicable Laws and Regulations

This Agreement shall be governed and construed in accordance with all applicable federal laws and all applicable substantive laws of the State of New Jersey and the Bylaws of the credit union as they now exist or may be hereafter amended. You understand that we must comply with these laws, regulations, and rules. You agree that if there is any inconsistency between the terms of the Agreement and any applicable law, regulation, or rule, the terms of this Agreement will prevail to the extent any such law, regulation, or rule may be modified by agreement between us.

22. Disclosures

You hereby acknowledge receipt of this Online Bill Payment Disclosure & Agreement informing you of your rights under the Electronic Funds Transfer Act.

i. e-Pay is FREE with our Checking Account and MasterCard Debit Card, otherwise, there is a $6.95 monthly fee.
