This Agreement between you and Jersey Shore Federal Credit Union contains the terms, conditions and disclosures for Jersey Shore Federal Credit Union e-Branch Services for which you have applied. In this agreement the terms ("Us", "Our" or "We") mean the credit union and the words ("I", "you" and "your") meaning each person signing the application as applicant, joint owner or authorized users and/or using e-Branch and the word "account" meaning any one or more accounts you have with the credit union hereby agree to be legally bound by the following terms and conditions.
1. Account Access
I understand that to use e-Branch, I must have a personal computer sufficient to use this software, Internet access through an Internet service provider (ISP) and Internet browser software.
I also understand that the Credit Union does not make any warranties on any equipment, hardware, software or ISP, or any part of them, express or implied, including, without limitation and warranties of merchantability or fitness for a particular purpose. The Credit Union is not responsible for any loss, injury or damages, whether direct, indirect or consequential, caused by the ISP, modem connection, any related software or the Credit Union’s e-Branch or the use of any of them or arising in anyway out of the installation, use or maintenance of your personal computer hardware, software or other equipment.
I further understand that e-Branch is available seven (7) days a week, twenty-four (24) hours a day except during system updates, network maintenance and technical difficulties and that the Credit Union cannot guarantee account access using e-Branch.
2. Account Information
The account balance and transaction history information may be limited to recent account information involving your accounts. Also, the availability of funds for transfer or withdrawal may be limited due to the processing time for unposted transactions such as ATM, MasterCard Debit Card and our Funds Availability PolicyOpens in New Window.
3. E-Mail
E-mail communications that you send may not be received immediately and the credit union may not be able to take action. If you need to contact the credit union immediately regarding an unauthorized transaction please call us at the number set forth in the Contacting the Credit Union Section 10.
4. Password
A separate temporary password will be assigned which I will be forced to change before I will be permitted to continue using e-Branch. I understand that e-Branch can and will perform many of the same tasks as a human teller. I acknowledge that the password I use is my signature, which identifies me as the user at e-Branch and authenticates and validates the directions given just as my actual signature and other proof identify me and authenticate and validate my directions to a human teller. I also acknowledge that my password is an identification code that’s personal and confidential and that the use of the password at e-Branch is a security method by which you are helping me to maintain the security of my account(s). Therefore, I AGREE TO TAKE ALL REASONABLE PRECAUTIONS THAT NO ONE ELSE LEARNS MY PASSWORD.
5. Accounts and Use of Service
You may use your password to perform any of the following transactions authorized through e-Branch.
Review account histories and balances for all open accounts and loan information.
Transfer funds between eligible accounts or to make a loan payment and receive a confirmation number for the transfer.
Withdraw funds and receive confirmation number. Certain withdrawal dollar limits have been imposed. You will need to contact the credit union for these amounts. Checks will be mailed by the next business day payable to you as a primary member and will be mailed to the address on record with the credit union. Any amounts over $3,000.00 will be sent by certified mail.
Transfers from eligible Lines of Credit (LOC) and receive a confirmation number. Any transfers from lines of credit will result in you obtaining a loan or advance under the terms previously disclosed to you.
Change password that allows access to financial functions.
Access Web Loan to complete and submit loan applications.
6. Limitations
Please be informed that some accounts are restricted to withdrawals. However, you may make transfers into these accounts.
You cannot withdraw from Holiday or Vacation Club accounts.
IRA (Individual Retirement Account) transactions will not be allowed.
You may not make address or other personal information changes such as date of birth, name changes etc.
There is no limit to the number of inquiries, transfers, or withdrawal request you may make in one day.
For your protection, security restrictions regarding log-on attempts have been implemented. The number of attempts is not revealed for security reasons.
You may not purchase a Share Certificate.
Jersey Shore Federal Credit Union MasterCard credit card transfers/payments made by 5:00pm ET will be posted to the card effective the same day. After that cutoff time, payments will be posted on and effective the next business day.
7. Record of Transactions
You will receive a confirmation number for each completed transaction performed using e-Branch. Also, you will receive a monthly statement showing the status of your account(s), transactions made during the past month, and any charges we may impose for such services or transactions.
8. Our Liability for Failure to Make an Electronic Fund Transfer
If we do not complete a transaction on time or in the correct amount, when properly instructed by you, we will be liable for damages caused by our failure unless:
You do not have enough money in your account to make the transfer through no fault of ours;
The transaction you request would exceed the available funds in your account and any overdraft credit;
Circumstances beyond our control (such as fire, flood, electrical power outage, and computer failure) prevent the transaction from completing;
Your account funds are subject to legal process or other encumbrance restricting the transaction;
We have reason to believe the transaction requested is unauthorized;
You attempt to perform a transaction that is not a permissible transaction;
We are holding uncollected funds in your account and the transfer would require the use of those funds. In any case, we shall only be liable for actual proven damages if the failure to make the transaction resulted from a bona fide error despite our procedures to avoid such errors.
9. Liability for Unauthorized Transactions
I agree to contact you at once if I believe the security of my password has been lost or stolen or any unauthorized activity appears on my account(s). Telephoning is the best way of keeping your possible losses down. If you tell us within two business day, you can lose no more than $50 if someone accessed your account without your permission. If you do not tell us within two business days after you learn of the loss or theft, and we can prove we could have stopped someone from accessing your account without your permission if you had told us, you could lose as much as $500.00. I also agree that if my monthly statement shows transactions which I did not make or authorize, and I do not contact you within 60 days after the statement was mailed to me, I may not recover any monies lost after that time. I AGREE THAT IF I GIVE MY PASSWORD TO SOMEONE ELSE TO USE, I AM AUTHORIZING THEM TO ACT ON MY BEHALF AND I WILL BE RESPONSIBLE FOR ANY USE OF THE PASSWORD BY THEM. If extenuating circumstances kept you from informing us of the loss or theft, we will reasonably extend time periods.
10. Contacting the Credit Union
I agree to contact you immediately, if unauthorized activity occurs on my account by telephoning the credit union at 609-646-3339 extension 111 Monday through Friday (Saturdays, Sunday and Holidays are not included) and by confirming such in writing at:

11. In Case of Errors or Questions About your Transactions
In case of errors or questions about your e-Branch transactions appearing on your statement, telephone or write to us as soon as possible. We must hear from you no later than 60 days after we sent you the first statement on which the problem or error appeared. Please include:
Your name, account number
A description of the suspected error or the transaction you are unsure of with an explanation of why you believe it is an error or why you need more information: and
The dollar amount of the suspected error
We will investigate your complaint and will correct any error promptly. If you report a suspect error or question a transaction by telephone or by email we may require you to send us your complaint or question in writing within ten (10) business days. Our business days are Monday through Friday excluding Saturday, Sunday and legal holidays.
After we receive your complaint or inquiry, we will tell you the results of our investigation within ten (10) business days but no later than 45 calendar days after receiving a notice of error. If a notice of error involves an electronic fund transfer that was not initiated in the United States of America the applicable time period for action shall be twenty (20) business in place of 10 business days, and 90 calendar days in place of forty-five (45) days.
If we decide that there is no error, we will send you a written explanation within three (3) days after we finish our investigation.
12. Privacy Statement
We will disclose account information to third parties:
Where it is necessary to complete transactions;
To verify the existence and standing of your account with us upon the request;
In order to comply with government agency rules, court orders or other applicable law;
To our employees, service providers, auditors, collection agents or attorneys in accordance with their duties; or
If you give written permission.
13. Amendments
I agree that from time to time you may amend or change the terms of this e-Branch Agreement including amendments or changes to add further services or to amend or change the charge for these services. You may do so by notifying me in writing of such amendments or changes and the use of e-Branch after the effective date of any such amendment or change shall constitute my acceptance of an agreement to such amendment or change. We will give you at least 30 days notice by mailing a copy of the amendment to you at your most recent address shown on our records.
14. Ownership
I agree that this account is not transferable. I agree the use of e-Branch is a privilege and the credit union has the right to suspend or terminate the use of e-Branch by notifying me orally and in writing.
15. Suspension of Privileges
We may at any time, and in our sole discretion, limit or terminate the e-Branch services we offer you. e-Branch services will be terminated if a period of 90 days or more elapses and the service has not been used .
16. Right of Offset
I/We agree that any and all shares in the credit union are pledged for any debts and loans owed to the credit union.
17. Enforcement
You agree to be liable to the credit union for any liability, loss or expense as provided in this Agreement that the credit union incurs as a result of any dispute involving your accounts or services. In the event either party brings a legal action to enforce the Agreement or collect any overdrawn funds on accounts accessed under this Agreement, the prevailing party shall be entitled, subject to applicable law, to payment by the other party of its reasonable attorney’s fees and costs, including fees on any appeal, bankruptcy proceedings, and any post-judgment collection actions, if applicable.
18. Applicable Laws and Regulations
This Agreement shall be governed and construed in accordance with all applicable federal laws and all applicable substantive laws of the State of New Jersey and the Bylaws of the credit union as they now exist or may be hereafter amended. You understand that we must comply with these laws, regulations, and rules. You agree that if there is any inconsistency between the terms of the Agreement and any applicable law, regulation, or rule, the terms of this Agreement will prevail to the extent any such law, regulation, or rule may be modified by agreement between us.
19. Disclosures
I hereby acknowledge receipt of the e-Branch Agreement and Disclosure Statement informing me of my rights under the Electronic Funds Transfer Act.
